Padelplay operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). PadelPlay is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.
Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described in this Privacy Policy.
Personal Information We Collect or Process
When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified, so that it cannot identify or be reasonably linked to you. We may collect or process the following categories of personal information, including inferences drawn from this personal information, depending on how you interact with the Services, where you live, and as permitted or required by applicable law:

Location and Bluetooth Information To provide certain features of the Services, particularly those related to our sensor connectivity and tracking functionality, we collect and process location information through Bluetooth technology. This includes:
- Bluetooth Connectivity Data: Information necessary to establish and maintain connections with PadelPlay sensors and devices during your sessions.
- Foreground Location Access: Location permissions required for Bluetooth functionality when you are actively using the Services.
- Background Location Access: On certain devices (including Android devices), location permissions necessary to maintain stable Bluetooth connections to sensors during sessions that continue while the Services run in the background or when your device is locked.
The collection of location information in connection with Bluetooth is essential for the core functionality of our sensor-based features and to ensure uninterrupted connectivity during your sessions. We do not use this location information for tracking your physical location or movements beyond what is necessary to maintain Bluetooth connections with our devices. Location permissions are requested and used solely to enable the technical requirements of Bluetooth connectivity as required by your device's operating system.
- Usage information including information regarding your interaction with the Services, including how and when you interact with or navigate the Services.
Health and Fitness Data
To provide certain features of the Services, the PadelPlay app may access and process health and fitness data through Apple HealthKit and Google Health Connect. We only access this data after you have granted explicit permission through these platform-level frameworks on your device. The app uses read-only access and does not write, modify, or delete any data within Apple Health or Google Health Connect.
Data we process. With your consent, and depending on what is available from your device and connected sensors, we access heart rate and step count. We read health samples recorded during and around your padel sessions to display session effort levels, generate post-session activity summaries, and provide performance insights intended to help you track and improve your game.
Legal basis. Health data is a special category of personal data under the General Data Protection Regulation (GDPR). We process it solely on the basis of your explicit consent (Article 9(2)(a) GDPR), which you provide through the permission frameworks on your device. You may withdraw this consent at any time (see below), without affecting the lawfulness of processing carried out before withdrawal.
How we use it. This data is securely transmitted to our backend systems and processed only to provide the core functionality described above. We do not use health data for advertising, marketing profiling, or behavioural advertising, and we do not sell health data to third parties. Only the minimum data necessary to provide the functionality is collected and processed.
Security. Health data is handled using industry-standard practices, including encrypted transmission and strict access controls.
Your control and retention. You may revoke the app's access to health data at any time through your device settings (Apple Health or Google Health Connect). You may also request deletion of your account and all associated health data by contacting us at info@padelplay.ai. We will delete your stored health data within 30 days of such a request, unless retention is required by applicable law. Where you do not request deletion, we retain health data only for as long as needed to provide the Services and your account remains active.
Not a medical device. The Services are intended for sports performance and informational purposes only and do not provide medical diagnosis, treatment, or clinical advice. PadelPlay is not a medical device and should not be used as a substitute for professional healthcare consultation.

We may collect personal information from the following sources:
- Directly from you including when you create an account, visit or use the Services, communicate with us, or otherwise provide us with your personal information;
- Automatically through the Services including from your device when you use our products or services or visit our websites, and through the use of cookies and similar technologies;
- From our service providers including when we engage them to enable certain technology and when they collect or process your personal information on our behalf;
- From our partners or other third parties.
How We Use Your Personal Information
Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:
- Provide, Tailor, and Improve the Services. We use your personal information to provide you with the Services, including to perform our contract with you, to process your payments, to fulfill your orders, to remember your preferences and items you are interested in, to send notifications to you related to your account, to process purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, to facilitate any returns and exchanges, to enable you to post reviews, and to create a customized shopping experience for you, such as recommending products related to your purchases. This may include using your personal information to better tailor and improve the Services.
- Marketing and Advertising. We use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you online advertisements for products or services on the Services or other websites, including based on items you previously have purchased or added to your cart and other activity on the Services.
- Security and Fraud Prevention. We use your personal information to authenticate your account, to provide a secure payment and shopping experience, detect, investigate or take action regarding possible fraudulent, illegal, unsafe, or malicious activity, protect public safety, and to secure our services. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password or other access details with anyone else.
- Communicating with You. We use your personal information to provide you with customer support, to be responsive to you, to provide effective services to you and to maintain our business relationship with you.
- Legal Reasons. We use your personal information to comply with applicable law or respond to valid legal process, including requests from law enforcement or government agencies, to investigate or participate in civil discovery, potential or actual litigation, or other adversarial legal proceedings, and to enforce or investigate potential violations of our terms or policies.
How We Disclose Personal Information
In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. Such circumstances may include:
- With Shopify, vendors and other third parties who perform services on our behalf (e.g. IT management, payment processing, data analytics, customer support, cloud storage, fulfillment and shipping).
- With business and marketing partners to provide marketing services and advertise to you. For example, we use Shopify to support personalized advertising with third-party services based on your online activity with different merchants and websites. Our business and marketing partners will use your information in accordance with their own privacy notices. Depending on where you reside, you may have a right to direct us not to share information about you to show you targeted advertisements and marketing based on your online activity with different merchants and websites. You can exercise your rights to opt-out of those uses here.
- When you direct, request us or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations.
- With our affiliates or otherwise within our corporate group.
- In connection with a business transaction such as a merger or bankruptcy, to comply with any applicable legal obligations (including to respond to subpoenas, search warrants and similar requests), to enforce any applicable terms of service or policies, and to protect or defend the Services, our rights, and the rights of our users or others.
We do not disclose or use health data accessed through Apple HealthKit or Google Health Connect for advertising or marketing purposes, and we do not sell such data to third parties.
Social Features and Your Data
The PadelPlay app includes optional social features: a social feed, public profiles, following, player search, reactions, and social notifications. This section explains how we handle your personal information when you use them, and supplements the rest of this Privacy Policy.
Information we process. When you use the Social Features we process:
- Profile information: your display name, profile picture, country, and your public/private visibility setting;
- Activity and session data: sessions you complete and choose to share, including session name, type, outcome, duration, location, score, and any session picture;
- Social graph: who you follow, who follows you, and pending follow requests you send or receive;
- Interactions: reactions you give or receive and the read/unread status of your notifications;
- Search activity: the queries you enter to find other players; and
- Device information: a device push token, used to deliver social notifications where you have enabled them.
How we use it. We use this information to display your profile, activity, and statistics to others ac13. SOCIAL FEATURES AND USER CONTENT
13.1 Scope. The PadelPlay app includes optional social features that let you connect with other players and share your padel activity, including a social feed, public profiles, following other players, searching for players, reacting to sessions, and social notifications (together, the "Social Features"). These features are provided as part of the Services and are subject to these Terms, our Privacy Policy, and any applicable in-app guidelines.
13.2 Account and eligibility. To use the Social Features you must have a valid PadelPlay account and meet the minimum age required to use the Services in your country. You are responsible for activity that occurs through your account.
13.3 Profile and public visibility. Each account has a profile that may display your name, profile picture, country, follower and following counts, and aggregate padel statistics (such as matches played, trainings played, win rate, and level). You can set your account to public or private at any time in your settings:
(a) when your account is public, your completed sessions, activity, and statistics may be visible to any other user, including in the Discover feed, and other users may follow you instantly;
(b) when your account is private, your sessions and activity are visible only to followers you have approved, and other users must send a follow request that you approve or reject. Your name, picture, and follower counts remain visible so that other users can find and request to follow you.
If you switch your account from private to public, any pending follow requests are automatically approved and your activity becomes visible according to the public settings above.
13.4 Following, followers, and requests. Following another player causes their activity to appear in your Following feed; you may unfollow at any time. If you follow a private account, your follow is a request that the other user may approve or reject, and which you may cancel while pending. Users may reject requests or remove followers at their discretion and without explanation.
13.5 Content you share. Your session data (including session name, type, outcome, duration, location, score, and any session picture) may be shared through the Social Features according to your visibility settings. You represent that you have the right to share any content you post and that it does not infringe the rights of others or violate any law. You retain ownership of content you create; by sharing it through the Social Features you grant Padelplay B.V. a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display that content solely to operate and provide the Services.
13.6 Reactions. You may react to other users' sessions using the reactions provided in the app. Reactions, and the fact that you performed them, may be visible to the session owner and, where applicable, other users.
13.7 Appearing in other players' activity. When you take part in another player's session, you may be identified by name as a participant in that player's activity, even if your own account is private. Your visibility settings govern your own posted content and profile — not your presence as a named participant in sessions posted by others.
13.8 Acceptable use. When using the Social Features you agree not to:
(a) harass, threaten, impersonate, or abuse other users;
(b) post content that is unlawful, hateful, harmful, deceptive, or that infringes the rights of others;
(c) upload profile or session pictures you do not have the right to use, or that depict other people without their consent;
(d) use the search or following features to stalk, spam, or otherwise misuse another user's information;
(e) attempt to access data you are not authorised to see, or circumvent another user's privacy settings; or
(f) use automated means to scrape, harvest, or collect user data or content.
13.9 Moderation and enforcement. We may, but are not obliged to, review, remove, or restrict content and accounts that we reasonably believe breach these Terms or applicable law, and we may suspend or terminate access to the Social Features for users who do so. Content shared through the Social Features is created by users, not by Padelplay B.V.; we do not endorse and are not responsible for user-generated content, and you interact with other users at your own risk.
13.10 Optional use. The Social Features are optional. You can limit your participation by keeping your account private, unfollowing others, refraining from sharing content, or disabling social notifications in your device or app settings.

Social Features and Your Data

- Participation in others' sessions: if you play in another user's session, you may be shown by name in that user's activity even when your own account is private.
Privacy settings apply to your own posted content and profile activity and are enforced on our servers, not only within the app. This supplements "How We Disclose Personal Information".

Relationship with Shopify
The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.
Children's Data
The Services are not intended to be used by children, and we do not knowingly collect any personal information about children under the age of majority in your jurisdiction. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted. As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) personal information of individuals under 16 years of age.
Security and Retention of Your Information
Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.
How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide you with Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies.
Your Rights and Choices
Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.
